  1. NV: Mit dem Einwand der unzutreffenden Besteuerung nach § 23 Abs. 1 EStG hinsichtlich des anteiligen Wertzuwachses bis zum 31. März 1999 wird eine (vermeintlich) fehlerhafte Rechtsanwendung durch das FG gerügt, also materiell-rechtliche Fehler; damit kann die Zulassung der Revision nicht erreicht werden.

  2. NV: Verfassungsrechtliche Bedenken hinsichtlich einer Besteuerung nach § 23 Abs. 1 Satz 1 Nr. 1 Satz 1 EStG bestehen jedenfalls dann nicht, wenn die zuvor geltende zweijährige Spekulationsfrist im Zeitpunkt der Gesetzesverkündung (31. März 1999) bezogen auf den Erwerb (22. Juli 1997) noch nicht abgelaufen war.

Gründe

1 Die Beschwerde ist unzulässig.

2 1. Ihre Begründung entspricht nicht den Darlegungsanforderungen des § 116 Abs. 3 Satz 3 der Finanzgerichtsordnung (FGO). Die fachkundig vertretene Klägerin und Beschwerdeführerin (Klägerin) hat Zulassungsgründe i.S. von § 115 Abs. 2 FGO schon nicht benannt.

3 a) Mit dem (hauptsächlichen) Einwand der unzutreffenden Besteuerung nach § 23 Abs. 1 des Einkommensteuergesetzes i.d.F. des Streitjahres (EStG) hinsichtlich des anteiligen Wertzuwachses bis zum 31. März 1999 rügt die Klägerin eine (vermeintlich) fehlerhafte Rechtsanwendung durch das Finanzgericht (FG), also materiell-rechtliche Fehler; damit kann die Zulassung der Revision indes nicht erreicht werden (ständige Rechtsprechung, z.B. Beschlüsse des Bundesfinanzhofs --BFH-- vom 22. Januar 2007 VI B 98/06, BFH/NV 2007, 949; vom 15. April 2008 IX B 154/07, BFH/NV 2008, 1340, unter 1.c, m.w.N.).

4 b) Auch die (allenfalls konkludent) aufgeworfene Rechtsfrage zu § 23 Abs. 1 Satz 1 Nr. 1 Satz 1 EStG ist hinreichend geklärt. Denn verfassungsrechtliche Bedenken bestehen jedenfalls dann nicht, wenn --wie im Streitfall-- die zuvor geltende zweijährige Spekulationsfrist im Zeitpunkt der Gesetzesverkündung (31. März 1999) bezogen auf den Erwerb (22. Juli 1997) noch nicht abgelaufen war; insoweit ist das Vertrauen in die zuvor geltende zweijährige Spekulationsfrist nicht schutzwürdig (vgl. BFH-Beschlüsse vom 19. Juni 2009 IX B 46/09, BFH/NV 2009, 1437; vom 23. Dezember 2009 IX B 72/09, BFH/NV 2010, 932). Entsprechend kommt auch die begehrte Nichtversteuerung des anteiligen Wertzuwachses bis zum 31. März 1999 nicht in Betracht (s. auch Bundesministerium der Finanzen, Schreiben vom 20. Dezember 2010, BStBl I 2011, 14, unter III.).

5 c) Schließlich kann mit der Nichtzulassungsbeschwerde nur die Zulassung der Revision (oder eine Zurückverweisung der Sache gemäß § 116 Abs. 6 FGO) erreicht werden. Daher ist der von der Klägerin gestellte Antrag zur Sache (sinngemäß: das Urteil des FG aufzuheben und den Einkommensteuerbescheid 2006 zu ändern) der --vom FG nicht zugelassenen und hier auch nicht eingelegten-- Revision vorbehalten und also nicht zielführend.

6 d) Die im nach Ablauf der Begründungsfrist und damit verspätet eingereichten Schriftsatz vom 1. Juni 2011 enthaltenen Ausführungen sind, soweit sie nicht nur erläuternder, ergänzender oder vervollständigender Natur sind, unbeachtlich (vgl. BFH-Beschlüsse vom 5. Juni 2008 IX B 249/07, BFH/NV 2008, 1512, unter 4.b; vom 25. September 2006 VI B 69/05, BFH/NV 2007, 83, unter 3., m.w.N.).
