Non-admission complaint rejected for lack of fundamental significance

BFH IX B 19/13Bfh / Division 908.07.2013Dismissed

Von Omnilex extrahiert

Omnilex-Zusammenfassung

The BFH dismissed the non-admission complaint against a Hessian Fiscal Court judgment. It held that the complaint did not show fundamental significance because it only attacked the lower court's assessment of the taxpayer's duty to cooperate in the individual case. In addition, the fiscal court had given cumulative reasons, and the complainant failed to demonstrate an admissibility ground for each independent reason, including the refusal to suspend the objection proceedings. The court therefore gave no further reasons.

Omnilex-Regeste

§ 115 Abs. 2 Nr. 1 FGO; attacks on the correctness of the fiscal court's assessment in the individual case do not establish fundamental significance. A question is of fundamental importance only if it concerns an abstract issue requiring clarification in the interest of the general public. Where the challenged judgment rests on cumulative, independent grounds, a ground for admission of revision must be substantiated and present for each separate ground; otherwise admission is precluded (consid. 2-3).

Leitsatz

Halbsatz FGO abgesehen.

Von Omnilex extrahiert

Kernrechtsfrage

Whether the complaint showed fundamental importance under Section 115(2)(1) FGO.

Extrahierter Entscheid

No. The challenge concerned only the fiscal court's assessment of the taxpayer's duty to cooperate in the individual case and did not raise an abstract legal question of general interest.

Extrahierte Begründung

Attacks on the correctness of the lower court's factual and legal assessment in an individual case cannot justify admission of the appeal.

Kernrechtsfrage

Whether admission could be justified despite the fiscal court's cumulative reasoning, including the taxpayer's request to suspend the objection proceedings.

Extrahierter Entscheid

No. Because the lower court relied on cumulative reasons, a ground for admission had to be shown for each independent reason; none was presented for the suspension-request ground.

Extrahierte Begründung

When a judgment is based on multiple cumulative grounds, an admissibility ground must be substantiated and exist for each ground to support admission of revision.
