Gründe

1 Die Klägerin hat ihre Revision gegen das Urteil des Verwaltungsgerichtshofs Baden-Württemberg vom 24. Januar 2003 mit Schriftsatz vom 10. Mai 2013 mit Einwilligung der Revisionsbeklagten vom 22. Mai 2013 zurückgenommen. Das Revisionsverfahren ist deshalb gemäß § 141 Satz 1, § 125 Abs. 1 Satz 1, § 92 Abs. 3 Satz 1 VwGO einzustellen.

2 Der Beigeladene zu 1 hat der Zurücknahme der Revision widersprochen. Darauf kommt es prozessual indes nicht an. Ein Beigeladener kann nach § 66 VwGO lediglich Sachanträge stellen, aber nicht verhindern, dass der Streit ohne seine Zustimmung beendet wird. Dies folgt aus seiner abhängigen Stellung im Prozess, die selbst im Falle einer notwendigen Beiladung nicht entfällt (Urteil vom 15. November 1991 - BVerwG 4 C 27.90 - NVwZ-RR 1992, 276; Beschluss vom 7. Juni 1968 - BVerwG 4 B 165.67 - NJW 1968, 2395).
