IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF ALASKA UNITED STATES OF AMERICA, Plaintiff, v. MICHAEL JOSEPH COOKSEY, Defendant. Case No. 3:19-CR-00014-SLG-DMS ORDER At an arraignment on first superseding indictment (Docket 69) and proposed change of plea hearing held before Judge Deborah M. Smith, defendant Michael Joseph Cooksey entered an oral plea of guilty to Count 1 of the First Superseding Indictment. At Docket 78, Judge Smith issued her Final Report and Recommendation, in which she recommended that the District Court accept the defendant’s guilty plea. No objections to the Final Report and Recommendation were filed. The matter is now before this Court pursuant to 28 U.S.C. § 636(b)(1). That statute provides that a district court “may accept, reject, or modify, in whole or in part, the findings or recommendations made by the magistrate judge.”1 A court is to “make a de novo determination of those portions of the magistrate judge’s report 1 28 U.S.C. § 636(b)(1). The Court has reviewed the Final Report and Recommendation and agrees with its analysis. Accordingly, the Court adopts the Final Report and Recommendation, and IT IS ORDERED that Mr. Cooksey’s guilty plea to Count 1 of the First Superseding Indictment is ACCEPTED and he is adjudged GUILTY of Count 1. IT IS FURTHER ORDERED that the Court ACCEPTS Mr. Cooksey’s admission to the forfeiture allegation. The Court’s decision on whether to accept the terms of the parties’ plea agreement will be deferred until a pre-sentence report by the probation office and any written objections have been filed.
