COURT OF APPEALS
THIRTEENTH DISTRICT OF TEXAS
CORPUS CHRISTI – EDINBURG
FRANK ROBERTS A/K/A
FRANK ALLEN ROBERTS, Appellant,
v.
THE STATE OF TEXAS, Appellee.
ON APPEAL FROM THE 148TH DISTRICT COURT
OF NUECES COUNTY, TEXAS
ORDER TO FILE APPELLANT’S BRIEF
Before Justices Silva, Peña, and West
Order Per Curiam
This cause is before the Court on appellant’s failure to file the appellate brief.
Appellant’s brief was originally due on August 14, 2026. On August 28, 2026, appellant
filed a motion for extension of time to file his brief. On September 3, 2026, we granted
appellant’s motion for extension of time, that the Clerk of the Court notified appellant that

his brief was now due on September 14, 2026. On September 16, 2026, the Clerk of the
Court notified appellant that his brief was past due, and that appellant had five days from
the notice date to file his brief. On September 21, 2026, appellant filed a second motion
for extension of time to file his brief which was granted. The Clerk of the Court notified
appellant that no further extensions of time would be granted absent new and exigent
circumstances. To date, appellant has failed to file his brief.
The Court looks with disfavor upon counsel’s delay in filing the appellate brief.
The Court, having fully examined and considered the timeline and appellant’s failure to
file a brief in this cause, is of the opinion that, in the interest of justice, appellant’s
brief should now be due by order.
IT IS THEREFORE ORDERED that the Honorable Kimbel Brandon, counsel
for appellant, file appellant’s brief with this Court on or before 5:00 p.m. on Friday,
October 30, 2026. If the Honorable Kimbel Brandon fails to file the brief as ordered,
counsel may be ordered to show cause why he should not be held in contempt of
court, or the matter may be referred back to the trial court. No further extensions
shall be given absent new and exigent circumstances.
PER CURIAM
Do not publish.
TEX . R. A PP . P. 47.2(b).
Delivered and filed on the
22nd day of October, 2026.
