COURT OF APPEALS
EIGHTH DISTRICT OF TEXAS
EL PASO, TEXAS
————————————
No. 08-26-00337-CV
————————————
In the Guardianship of Anna Lee Faulk, Appellant
On Appeal from the Probate Court No. 2
Travis County, Texas
Trial Court No. C-1-PB-24-001600
M E MO RA N D UM O PI NI O N
On September 23, 2026, Richard A. Faulk filed a notice of appeal attempting to appeal
from an order entered by Probate Court No. 2 in Travis County, Texas. The notice of appeal
indicates that the appeal is being taken to the Eighth Court of Appeals in El Paso, Texas. On
September 25, 2026, the Clerk of this Court notified Faulk that this Court lacked jurisdiction over
this appeal because it is outside our district. The notice informed Faulk that this appeal would be
dismissed for want of jurisdiction unless, within ten days of the date of the notice, he filed a
response showing grounds for this Court’s jurisdiction. To date, Faulk has not responded.
Our jurisdiction is limited to cases arising from within our district. See Tex. Const. art.
V, § 6(a) (“Court[s] of Appeals shall have appellate jurisdiction co-extensive with the limits of
2
their respective districts[.]”); Tex. Gov’t Code § 22.220(a). Travis County is not within our district.
See Tex. Gov’t Code § 22.201(d) (listing Travis County within the Third Court of Appeals District).
Under the Supreme Court of Texas’s docket equalization efforts, certain appeals are transferred to
us from other districts. See Tex. Gov’t Code § 73.001(a) (providing that “the supreme court may
order cases transferred from one court of appeals to another at any time that, in the opinion of the
supreme court, there is good cause for the transfer”). Unless and until appeals from counties
outside our district are properly transferred to us, we lack jurisdiction to hear them. See, e.g.,
Spence v. Federal Home Mortgage Corp., No. 13-24-00174-CV, 2024 WL 3197476, at *1
(Tex. App.—Corpus Christi-Edinburg Jun. 27, 2026, no. pet) (mem. op.) (dismissing appeal from
outside the appellate court’s district for want of jurisdiction). This particular appeal was not
properly transferred to us, but was instead filed directly in our Court by the litigant.
Accordingly, we dismiss this appeal for want of jurisdiction. Tex. R. App. P. 42.3(a).
LISA J. SOTO, Justice

Before Salas Mendoza, C.J., Palafox and Soto, JJ.
