FIRST CLASS CITIES, REGULATING FENCES
Act of Jun. 22, 1917, P.L. 621, No. 213 Cl. 11
AN ACT
Relating to division fences in suburban and similar districts of
cities of the first class; regulating the nature, height,
materials, and kind thereof; defining the same; and in
certain cases dispensing with the same on whole or parts of
boundary lines; also prohibiting in the said districts the
erection of fences or similar structures above a certain
height, except under a permit.
Section 1. Be it enacted, &c., That in all suburban
districts of cities of the first class, whether the premises
concerned in said districts be assessed at rural, suburban, or
city rates, wherever on improved premises a dwelling-house has
been or may be erected that is detached or semidetached from the
dwelling-house on the adjoining premises, and that is separated
from the street on which it fronts by an intervening front yard,
lawn, or space, no partition or division fence between such
adjoining improved premises shall be required on or along that
part of the boundary line that extends from the building line of
the said detached or semidetached dwelling-houses to the
sidewalk or pavement: Provided, That nothing in this act shall
prohibit any occupant or owner of any such premises from
erecting a division fence on or along such part of said boundary
line, at his own cost: And provided, That no such fence shall be
more than four feet high, without a permit therefor having been
first obtained from the Bureau of Building Inspection.
Section 2. That, in the districts named in section one
hereof, the division fence between adjoining improved premises,
required by law, may be boards, palisades, pickets, palings,
iron, or wire; or may be a wall of brick, stone, or concrete, or
may be a hedge; or a combination of any of these styles and
materials, as the owners or occupants of the said adjoining
improved premises may agree: Provided, That no such fence shall
be more than four feet high, without a permit therefor having
been first obtained from the Bureau of Building Inspection.
Section 3. (3 repealed May 12, 1965, P.L.58, No.45)
Section 4. That, owners or occupants of adjoining improved
premises in said districts shall not be required to erect,
build, plant, keep or maintain any division fence whatever, upon
any part of their common boundary line, if they agree to
dispense with and be without the same.
