REQUIRING A GUARD TO BE POSTED WHEN A MANHOLE IS ENTERED
Act of Aug. 22, 1961, P.L. 1034, No. 467 Cl. 12
AN ACT
Requiring a guard to be posted when a manhole is entered;
imposing powers and duties on the Department of Labor and
Industry; and authorizing said department to promulgate rules
and regulations relating to manholes, and providing
penalties.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Any person whose duties require him to enter a
manhole, or who allows another under his supervision to do so,
without having a person act as a guard at the entrance to the
manhole, or who violates any rules or regulations of the
Department of Labor and Industry promulgated pursuant to this
act, shall, upon summary conviction, be sentenced to pay a fine
of not less than ten dollars ($10) and not more than fifty
dollars ($50), and, in default of the payment thereof, undergo
imprisonment for a period not exceeding that ten days.
Section 2. It shall be the duty of the Department of Labor
and Industry to enforce the provisions of this act, and to
promulgate rules and regulations relating to manholes and
protection of the public from the dangers thereof not
inconsistent with the provisions of section 1 of this act. The
Department of Labor and Industry shall have the power to inspect
and enter any manhole to ensure compliance with this act or any
rules or regulations promulgated pursuant thereto, and shall
have the power to stop any operation involving the use of a
manhole until the provisions of this act and the rules and
regulations promulgated pursuant thereto are complied with.
