Pennsylvania Act 1981-6 — PROJECT 70 LAND USE CHANGE - HARBORCREEK TOWNSHIP

AN ACT

Authorizing the Township of Harborcreek, Erie County, to utilize a portion of land acquired pursuant to the provisions of the "Project 70 Land Acquisition and Borrowing Act" for other than the prescribed recreation, conservation and historical purposes.

The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows:

Section 1. The Township of Harborcreek, Erie County, is authorized, subject to the acquisition by it of replacement land, to use 7.12 acres of the land acquired by it pursuant to the provisions of the act of June 22, 1964 (Sp.Sess., P.L.131, No.8), known as the "Project 70 Land Acquisition and Borrowing Act," included in the following descriptions for general municipal purposes.

Parcel "A" (North of Buffalo Road)

Beginning at a concrete monument, the northeast corner of the property. Thence south 37 degrees 03 minutes 52 seconds east 43.42 feet to a concrete monument on the north right-of-way of Buffalo Road, an 80 foot row; thence south 62 degrees 40 minutes 12 seconds west along said right-of-way 498.37 feet to a concrete monument; thence north 37 degrees 03 minutes 45 seconds west 43.48 feet to a concrete monument; thence north 62 degrees 40 minutes 12 seconds east 498.37 feet to the place of beginning. Containing .49 acre.

Parcel "B" (South of Buffalo Road)

Beginning at a concrete monument at the northwest corner of the property said point being on the south right-of-way line of Buffalo Road an 80 foot right-of-way. Thence north 62 degrees 40 minutes 12 seconds east along the southern right-of-way of Buffalo Road 498.37 feet to a concrete monument; thence south 37 degrees 03 minutes 52 seconds east 1470.01 feet to a concrete monument passing over a concrete monument at 1222.24 feet; thence south 62 degrees 40 minutes 12 seconds west 498.42 feet to a concrete monument; thence north 37 degrees 03 minutes 45 seconds west 1470.00 feet to the place of beginning. Containing 16.58 acres.

Section 2. The Township of Harborcreek, Erie County, shall, for the release of the use restrictions imposed by the "Project 70 Land Acquisition and Borrowing Act" on the 7.12 acres described in section 1, acquire replacement land acceptable to the Department of Community Affairs. The deed of transfer for the replacement land shall recite that it was acquired for recreation, conservation and historical purposes in accordance with provisions of the aforesaid act.

Compiler's Note: The Department of Community Affairs, referred to in this section, was abolished by Act 58 of 1996 and its functions were transferred to the Department of Community and Economic Development.

Section 3. This act shall take effect in 60 days.
