# COMMISSION REGULATION (EC) No 2152/2004

of 16 December 2004

repealing Regulation (EC) No 238/2004 opening an invitation to tender for the reduction in the duty on sorghum imported into Spain from third countries

## Preamble

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EC) No 1784/2003 of 29 September 2003 on the common organisation of the market in cereals [^1] , and in particular Article 12(1) thereof

Whereas:

**(1)** Commission Regulation (EC) No 1839/95 of 26 July 1995 laying down detailed rules for the application of tariff quotas for imports of maize and sorghum into Spain and imports of maize into Portugal [^2] lays down the specific rules required for carrying out invitations to tender.

**(2)** For economic reasons, the invitation to tender provided for in Commission Regulation (EC) No 238/2004 [^3] should be cancelled.

**(3)** The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Cereals,

HAS ADOPTED THIS REGULATION:

## **Article 1**

Regulation (EC) No 238/2004 is hereby repealed.

## **Article 2**

This Regulation shall enter into force on the day of its publication in the *Official Journal of the European Union* .

## Final provisions
