Art. 108g

The Federal Council shall regulate:

1. the units of the authorities referred to in Article 108e to which the powers specified therein apply;
2. the ETIAS data that the authorities may request in accordance with Article 108e paragraph 3 and the procedure for obtaining them;
3. the list of data in the EES and the access rights of the authorities under Article 108c paragraphs 1 and 2;
4. the storage and the deletion of the data;
5. the modalities in relation to data security;
6. responsibility for data processing;
7. the list of offences under Article 108c paragraph 3;
8. the modalities for recording data on the ETIAS watchlist and the deletion of data from the ETIAS watchlist as well as the restriction of the right of access to the watchlist;
9. the other modalities and procedures required to implement Regulation (EU) 2018/1240¹.
