Any person who wilfully breaches the obligation to give notice of vacant positions (Art. 21a para. 3) or the obligation to conduct an interview or an aptitude test (Art. 21a para. 4) is liable to a fine not exceeding 40 000 francs.
If the offence is committed through negligence, the penalty is a fine not exceeding 20 000 francs.
