The request for cancellation of a trade mark registration on the grounds of non-use of the trade mark must be submitted in two copies and must include:

  1. the surname and first name or the company name, the address of the applicant and, where applicable, their address for service in Switzerland;
  2. the number of the trade mark registration for which a cancellation is requested, as well as the name or company of the proprietor of the trade mark;
  3. a declaration of the extent of the cancellation;
  4. an explanation of the request for cancellation which, in particular, substantiates the claim of non-use;
  5. evidence.
