Art. 50a

The request for cancellation of an international registration on the grounds of non-use may be filed at the earliest:

1. if a notification of a provisional refusal of protection has been issued: five years after the conclusion of the procedure for the grant of protection in Switzerland;
2. if no refusal of protection has been issued: five years after expiry of the time limit for notification of the refusal of protection or five years following the statement of grant of protection.
