Any person who intentionally releases genetically modified or pathogenic organisms or the disrupts the operation of a facility for the research into, or the safeguarding, production or transport of such organisms shall be liable to a custodial sentence not exceeding ten years, provided they know or must reasonably believe that through their acts:
they will endanger the life and limb of people; or
the natural composition of communities of animals and plants or their habitats will be seriously endangered.
If the offence is committed through negligence, a custodial sentence not exceeding three years or a monetary penalty shall be imposed.
