Der freihändige Landerwerb ist zulässig, wenn das Grundstück höchstens zum Verkehrswert erworben werden kann. Bei der Ermittlung des Verkehrswertes sind die Landpreise der betreffenden Gegend sowie die Lage und die Nutzungsmöglichkeit des Grundstückes angemessen zu berücksichtigen.
