Wer das Luftfahrzeug ohne Wissen und Willen des Halters benützt, ist zum Ersatz des verursachten Schadens verpflichtet. Der Halter haftet mit, aber nur bis zum Betrage der Sicherstellung, zu der er gemäss den Artikeln 70 und 71 verpflichtet ist.
