Counterparties newly subject to the platform trading duty in accordance with Article 98 paragraph 2 or Article 99 paragraph 2 FinMIA do not have to trade transactions they concluded prior to the start of this duty via authorised or recognised trading venues or via operators of an organised trading facility.
Derivatives transactions with counterparties in accordance with Article 94 paragraph 1 FinMIA are not covered by the platform trading duty.
