Spruch

I. Dem Antrag auf Wiedereinsetzung in den vorigen Stand wird stattgegeben.

Der Beschluß des Verfassungsgerichtshofes vom 30. September 1997, B2041/97-5, wird aufgehoben.

II. Die Behandlung der Beschwerde wird abgelehnt.

Die Beschwerde wird dem Verwaltungsgerichtshof zur Entscheidung abgetreten.
