Spruch

1. zu Recht erkannt:

Das angefochtene Erkenntnis wird im Umfang des Ausspruches nach § 9 Abs. 3 BFAVG und der Erteilung eines Aufenthaltstitels nach § 55 AsylG 2005 wegen Rechtswidrigkeit infolge Unzuständigkeit des Verwaltungsgerichtes aufgehoben.

2. den Beschluss gefasst:

Im Übrigen wird die Revision zurückgewiesen.
