  1. Urtheil vom 23. September 1876 in Sachen Stalder. A. Christian Stalder verheirathete sich im Jahre 1866 mit Anna Engist von Konolfingen, welche vorher außerehelich einen Knaben geboren hatte. Obgleich Stalder nach seiner eigenen Erklärung nicht Vater dieses Knaben ist, beschwerte sich derselbe beim Bundesgerichte, daß die Gemeinde Rüegsau sich weigere, denselben als durch die nachfolgende Ehe legitimirt anzuerkennen und verlangte gestützt auf Art. 54 der Bundesverfassung, daß die Gemeinde hiezu verhalten werde. B. Der Gemeinderath Rüegsau trug auf Abweisung der Beschwerde an, da von einer Legitimation des von der Ehefrau Stalder außerehelich gebornen Knaben deßhalb keine Rede sein könne, weil Stalder nicht dessen Vater sei. Das Bundesgericht zieht in Erwägung: Die Legitimation eines unehelichen Kindes besteht darin, daß dasselbe seinen natürlichen Eltern, Vater und Mutter, gegenüber ehelich erklärt wird, d. h. die Rechte eines ehelichen Kindes erwirbt, insbesondere also in die Familie des Vaters eintritt und dessen Geschlechtsnamen und Bürgerrecht erhält. Die Vor aussetzung der Legitimation vorehelicher Kinder durch nachfolgende Ehe ist daher, wie übrigens aus Art. 54 Lemma 5 der Bundes verfassung deutlich ersichtlich ist, daß die Eltern (Vater und Mutter) derselben sich ehelichen, was im vorliegenden Falle nicht zutrifft, da Petent selbst erklärt, nicht der Vater des von seiner Ehefrau vorehelich gebornen Knaben zu sein. Als ein dem Petenten fremdes Kind kann sonach der Knabe von ihm nicht legitimirt, sondern nur vermittelst Adoption an Kindes statt angenommen werden. Allein über Zulässigkeit und Be dingungen der Adoption enthält die Bundesverfassung keine Bestimmungen, sondern es sind in dieser Hinsicht einzig die kantonalen Gesetze maßgebend. Demnach hat das Bundesgericht erkannt: Die Beschwerde ist als unbegründet abgewiesen.
