Erwägung 2

  1. Art. 59 BV hat nur interkantonale Bedeutung. Er kann demnach von dem im Kanton Graubünden wohnhaften Rekurrenten Simon Depuoz nicht angerufen werden, obwohl er seinen Wohnsitz nicht im Bezirk Heinzenberg, sondern in einem andern Bezirk des Kantons hat. Doch richtet sich die Klage nicht gegen diesen Rekurrenten allein, sondern gegen alle Söhne (Erben) des Fidel Depuoz als Streitgenossen und muss gegen alle gerichtet werden, wenn der Kläger ein der Vollstreckung fähiges Urteil erwirken will. Die Gutheissung der Beschwerde der andern Rekurrenten muss daher die Aufhebung der angefochtenen Verfügungen auch gegenüber Simon Depuoz nach sich ziehen.
