Omnilex summary

X. filed a criminal complaint against a decision of the District Court of Winterthur, but did not submit the challenged decision and did not explain why it was unlawful or unconstitutional. After the Federal Supreme Court asked him to file the decision, he did not respond. The Court therefore held that the complaint failed to meet the formal requirements and declared it inadmissible in summary procedure. In view of the circumstances, it exceptionally waived court costs.

Omnilex headnote

Art. 42 Abs. 2, Art. 106 Abs. 2, Art. 108 Abs. 1 BGG; inadmissibility for failure to submit the challenged decision and to substantiate the complaint. A Federal Supreme Court complaint must contain the challenged decision and a reasoned submission setting out, in a manner complying with the applicable standard of review, why the decision violates law or constitutional rights. If these requirements are manifestly not met, the Court may decline to enter into the matter in summary procedure under Art. 108 Abs. 1 BGG. Exceptionally, costs may be waived under Art. 66 Abs. 1 BGG where the circumstances so justify.

Urteil vom 10. Februar 2009
I. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Féraud, Präsident,
Gerichtsschreiber Bopp.

Parteien
X.________, Beschwerdeführer,

gegen

Bezirksgericht Winterthur, Lindstrasse 10,
8400 Winterthur.

Gegenstand
Strafverfahren,

Beschwerde gegen den Entscheid vom 8. Dezember 2008 des Bezirksgerichts Winterthur.
In Erwägung,
dass X.________ mit Eingabe vom 5./6. Dezember "2009", beim Bundesgericht eingegangen am 9. Januar 2009, gegen einen am 8. Dezember 2008 ergangenen Entscheid des Bezirksgerichts Winterthur der Sache nach Beschwerde in Strafsachen ans Bundesgericht führt;
dass er es unterlassen hat, zusammen mit seiner Beschwerde auch den angefochtenen Entscheid einzureichen;
dass das Bundesgericht den Beschwerdeführer mit Schreiben vom 9. Januar 2009 aufgefordert hat, den angefochtenen Entscheid bis am 16. Januar einzureichen;
dass der Beschwerdeführer nach erfolgter Zustellung des Schreibens nicht reagiert hat;
dass er abgesehen davon nicht darlegt, inwiefern der angefochtene Entscheid rechts- bzw. verfassungswidrig sein soll;
dass die Beschwerde daher den gesetzlichen Formerfordernissen (Art. 42 Abs. 2 und Art. 106 Abs. 2 BGG, s. in diesem Zusammenhang BGE 133 II 249 insb. E. 1.4 S. 254), auf die der Beschwerdeführer bereits früher hingewiesen worden ist, nicht zu genügen vermag, wehalb auf sie schon aus diesem Grund nicht einzutreten ist;
dass der Mangel offensichtlich ist, weshalb über die Beschwerde im vereinfachten Verfahren nach Art. 108 Abs. 1 BGG entschieden werden kann;
dass es sich bei den gegebenen Verhältnissen rechtfertigt, ausnahmsweise keine Kosten zu erheben (s. Art. 66 Abs. 1 BGG);

erkennt der Präsident:

Es werden keine Kosten erhoben.

3.

Key legal question

Whether the criminal complaint met the Federal Supreme Court's formal pleading requirements and was therefore admissible.

Extracted holding

The complaint did not satisfy the statutory formal requirements because the challenged decision was not filed and the alleged legal or constitutional violations were not substantiated.

Extracted reasoning

The appellant ignored a request to submit the decision and failed to comply with the duty to reason the complaint under Articles 42(2) and 106(2) BGG; the defect was obvious, so summary non-entry was appropriate.

Key legal question

Whether court costs should be charged despite inadmissibility.

Extracted holding

No costs were imposed in the circumstances.

Extracted reasoning

Given the situation, the court exceptionally waived costs under Article 66(1) BGG.
