Omnilex summary

The Federal Supreme Court held that the voting-rights complaint filed against the federal popular vote of 1 June 2008 was obviously inadmissible because it was not directed against a Federal Chancellery order or a cantonal government decision. Acting under the simplified procedure, the President therefore did not enter into the complaint. Court costs of CHF 300 were imposed on the appellant.

Omnilex headnote

Art. 88 Abs. 1 lit. b BGG; admissibility of a voting-rights complaint in federal matters. A complaint is admissible only against orders of the Federal Chancellery or decisions of cantonal governments. A challenge directed solely against the conduct or result of a federal popular vote, without attacking such an act, is manifestly inadmissible and may be disposed of by non-entry in simplified procedure under Art. 108 Abs. 1 lit. a BGG. Costs follow the outcome and are imposed on the unsuccessful complainant pursuant to Art. 66 Abs. 1 BGG.
