Omnilex summary

D.________ lodged a voting-rights complaint against the federal popular vote of 9 February 2003 concerning amendments to voting rights. The Federal Supreme Court held that a constitutional complaint was unavailable because it can only be directed against cantonal acts or votes, and that administrative judicial review in political-rights matters was likewise not open on the facts. The court therefore declined to enter into the matter. In an exception, it waived court costs.

Omnilex headnote

Art. 84 Abs. 1 OG, Art. 85 lit. a OG, Art. 100 lit. p OG, Art. 80 BPR; admissibility of complaints concerning federal popular votes. A constitutional complaint is inadmissible against federal, as opposed to cantonal, enactments, decisions, elections or votes. Administrative judicial review in matters of political rights is available only exceptionally and within the narrow limits expressly provided by federal law; absent such a statutory basis, the Federal Supreme Court does not enter into the complaint. A waiver of court costs may be granted exceptionally in a non-entry decision (consid. 1-2).

Urteil vom 14. Februar 2003
I. Öffentlichrechtliche Abteilung

Bundesgerichtspräsident Aemisegger, Präsident,
Bundesgerichtsvizepräsident Nay, Bundesrichter Aeschlimann,
Gerichtsschreiber Pfäffli.

D.________,
Beschwerdeführer,

gegen

Key legal question

Admissibility of a constitutional complaint against a federal popular vote

Extracted holding

A constitutional complaint is not admissible because it may only challenge cantonal enactments or decisions, or cantonal elections and votes.

Extracted reasoning

The challenged vote was federal, not cantonal, so Art. 84 and 85 OG exclude this remedy from the outset.

Key legal question

Admissibility of administrative judicial review in political-rights matters

Extracted holding

The complaint is also inadmissible as administrative judicial review is available in political-rights matters only within a very limited scope, which is not met here.

Extracted reasoning

Under Art. 100 lit. p OG and Art. 80 BPR, the present challenge does not fall within the narrow admissible category.

Key legal question

Court costs

Extracted holding

No court costs are charged exceptionally.

Extracted reasoning

The court expressly waived costs.
