la demande d'assistance judiciaire du même jour tendant à la désignation d'un défenseur d'office en la personne de Me Vincent Willemin,
le décès de l'intéressé intervenu le 11 février 2013,
les art. 32 et 64 LTF,
considérant:
qu'il convient de constater que le recours est devenu sans objet et de rayer la cause du rôle,
qu'il convient d'accorder l'assistance judiciaire, de désigner Me Vincent Willemin comme défenseur d'office en procédure devant le Tribunal fédéral, de lui octroyer une indemnité et de ne pas percevoir de frais de justice,
par ces motifs, le Président ordonne:

La cause 2C_42/2013, devenue sans objet, est rayée du rôle.
2.
La requête d'assistance judiciaire est admise et Me Vincent Willemin désigné défenseur d'office.
3.
La Caisse du Tribunal fédéral versera au défenseur d'office une indemnité de 1500 fr.
4.
Il n'est pas perçu de frais de justice.
5.
La présente ordonnance est communiquée au défenseur d'office, au Service des Migrations, Office de la population et des migrations du canton de Berne, à la Direction de la police et des affaires militaires du canton de Berne, au Tribunal administratif du canton de Berne, Cour des affaires de langue française, et à l'Office fédéral des migrations.
