Omnilex summary

X. challenged before the Federal Supreme Court a cantonal ruling declaring his appeal inadmissible for failure to pay an advance and provide a translation. He asked the Court to address the refusal of his settlement permit and his expulsion from Vaud. The Court held that federal review could extend only to the subject of the cantonal decision, namely the inadmissibility ruling, so the substantive requests were outside the scope of the appeal. It therefore dismissed the appeal as manifestly inadmissible and waived court costs.

Omnilex headnote

Art. 86 al. 1 let. d LTF; the Federal Supreme Court examines only the subject matter of the decision challenged before it. If the cantonal decision concerns solely the inadmissibility of a cantonal appeal, submissions directed against the underlying substantive administrative decision are inadmissible. Manifest inadmissibility may be dealt with under Art. 108 al. 1 let. a and b LTF without exchange of written submissions; in appropriate circumstances, court costs may be waived under Art. 66 al. 1 LTF.

Arrêt du 10 décembre 2010
IIe Cour de droit public

Composition
M. le Juge Zünd, Président.
Greffier: M. Dubey.

Participants à la procédure
X.________, recourant,

contre

Extracted by Omnilex

Key legal question

Whether the federal appeal could challenge the underlying permit and expulsion issues although the cantonal decision only concerned inadmissibility of the cantonal appeal.

Extracted holding

No. The federal appeal may concern only the subject of the challenged decision, namely the cantonal inadmissibility ruling.

Extracted reasoning

Under Art. 86(1)(d) LTF, the Court reviews only questions decided below. Since the cantonal decision dealt solely with inadmissibility, submissions about the residence permit and expulsion fell outside the scope of review.

Key legal question

Whether the appeal was manifestly inadmissible and could be decided in simplified procedure without an exchange of submissions.

Extracted holding

Yes. The appeal was manifestly inadmissible and could be handled under the simplified procedure.

Extracted reasoning

The lack of jurisdiction over the merits and the clear inadmissibility justified application of Art. 108(1)(a) and (b) LTF without further submissions.

Key legal question

Whether court costs should be charged to the appellant.

Extracted holding

No costs were charged.

Extracted reasoning

Given the circumstances, the Court waived judicial costs under Art. 66(1) LTF.
