Omnilex summary

A tenant challenged a cantonal judgment confirming an eviction order. The Federal Supreme Court held the appeal inadmissible because it was filed after the 30-day deadline and, in any event, did not satisfy the statutory reasoning requirement. The appellant failed to engage with the cantonal court’s grounds and instead attacked conduct in other proceedings. The court decided the matter under the simplified procedure, waived court costs, and awarded no compensation to the respondent, who had not been invited to file observations.

Omnilex headnote

Art. 100 cpv. 1 LTF; art. 42 cpv. 2 LTF; art. 108 cpv. 1 lett. b LTF: a federal appeal is inadmissible if lodged after expiry of the 30-day time limit and, independently thereof, if the appellant fails to substantiate the grievances by addressing the reasoning of the cantonal decision. General criticism of other proceedings or of prior judicial conduct does not satisfy the duty to reason the appeal. In such a case, the court may issue a summary non-entry decision in simplified procedure; costs may exceptionally be waived under art. 66 cpv. 1 LTF, and no party compensation is due where the respondent was not invited to respond (consid. 1-3).

Sentenza del 17 marzo 2008
I Corte di diritto civile

Composizione
Giudice federale Corboz, presidente,
cancelliera Gianinazzi.

Parti
A.________,
ricorrente,

contro

B.________SA,
opponente.

Oggetto
sfratto,

ricorso contro la sentenza emanata
il 16 novembre 2007 dalla II Camera civile
del Tribunale d'appello del Cantone Ticino.

Visto:
che con sentenza del 16 novembre 2007 la II Camera civile del Tribunale d'appello del Cantone Ticino ha respinto il ricorso interposto da A.________ contro il decreto di sfratto pronunciato nei suoi confronti dal Segretario assessore delle Pretura di Medrisio-Sud il 29 ottobre 2007;
che, seppur intimata il 20 novembre 2007, la decisione è stata consegnata a A.________ il 2/3 gennaio 2008;
che A.________ ha inoltrato al Tribunale federale un "ricorso in materia di locazione" datato 1° febbraio 2008, con la dicitura "Raccomandata anticipata per fax";
che, nonostante tale indicazione, in tale data al Tribunale federale non è pervenuta nessuna comunicazione via fax;
che l'allegato ricorsuale, spedito con raccomandata il 13 febbraio 2008, è giunto al Tribunale federale solo il 14 febbraio 2008;
che né la controparte né l'autorità cantonale sono state invitate a pronunciarsi sul gravame;

considerando:
che l'impugnativa dev'esser dichiarata inammissibile già perché tardiva, non essendo stata inoltrata entro il termine di 30 giorni dalla notificazione della decisione cantonale, così come prescritto dall'art. 100 cpv. 1 LTF;
che, anche prescindendo dalla questione della tempestività, il gravame risulta in ogni caso inammissibile siccome non motivato conformemente alle esigenze di legge (cfr. art. 42 cpv. 2 LTF);
che nel suo scritto, infatti, il ricorrente non prende minimamente posizione sulle ragioni per le quali il Tribunale d'appello ha deciso di confermare il decreto di sfratto, bensì critica l'agire del pretore e del segretario assessore della Pretura di Mendrisio Sud nell'ambito delle varie procedure giudiziarie che lo hanno coinvolto, non solo quelle relative alla locazione ma anche e soprattutto quelle concernenti l'obbligo di versamento del contributo alimentare a moglie e figlio nonché la sua domanda di annullamento del matrimonio;
che in queste circostanze si può decidere di non entrare nel merito del ricorso mediante la procedura semplificata dell'art. 108 cpv. 1 lett. b LTF;
che le circostanze del caso concreto giustificano anche di rinunciare ad addossare le spese giudiziarie al ricorrente soccombente (art. 66 cpv. 1 LTF);
che all'opponente, nemmeno invitata a presentare osservazioni, non spetta alcuna indennità per ripetibili della sede federale;

per questi motivi, il Presidente pronuncia:

1.
Il ricorso è inammissibile.

2.
Non si prelevano spese giudiziarie.

3.
Comunicazione alle parti e alla II Camera civile del Tribunale d'appello del Cantone Ticino.

Extracted by Omnilex

Key legal question

Whether the federal appeal was filed within the statutory deadline.

Extracted holding

The appeal was filed too late because it was not submitted within 30 days from notification of the cantonal decision.

Extracted reasoning

The decision had been served on 2/3 January 2008, whereas the federal filing reached the court only on 14 February 2008; no fax submission arrived on 1 February 2008.

Key legal question

Whether the appeal met the statutory reasoning requirements.

Extracted holding

The appeal was not sufficiently reasoned because it did not address the cantonal court's grounds for confirming the eviction order.

Extracted reasoning

The appellant instead criticized earlier judicial conduct in other proceedings, including maintenance and marriage-annulment matters, rather than challenging the reasoning of the cantonal judgment.
