Omnilex summary

The employee appealed to the Federal Supreme Court against a cantonal judgment that had rejected his claims for an employment certificate and compensation for conciliation proceedings. The Court held that the 30-day appeal period started the day after service of the cantonal judgment and expired before the appellant posted his appeal. Because the filing was late, the Court did not enter into the appeal. In view of the circumstances, it waived court costs.

Omnilex headnote

Under Art. 66 Abs. 1 second sentence BGG, court costs may be waived in special circumstances.
