Omnilex summary

X. appealed to the Federal Supreme Court in a tenancy eviction matter. After the Court ordered an advance on costs of CHF 3,000 and granted an additional deadline, the appellant still did not pay. The Court therefore held the appeal inadmissible for failure to pay the advance on costs. It also ordered that no judicial costs be charged. The decision was issued by the President of the First Civil Law Court.

Omnilex headnote

Art. 62 al. 3 LTF, Art. 108 al. 1 let. a LTF; inadmissibility for non-payment of the advance on costs. If the appellant fails to pay the advance on costs within the original or extended deadline, the appeal is not entered into. The prerequisite is objective non-compliance with the payment order; the Court may decide by summary order under Art. 108 al. 1 let. a LTF. Where no judicial costs are levied, this must be expressly stated in the operative part.

Key legal question

Whether the appeal had to be dismissed because the appellant failed to pay the required advance on costs within the deadline.

Extracted holding

Yes. Because the required advance on costs was not paid within the time limits set by the Court, the appeal was inadmissible.

Extracted reasoning

The Court had ordered payment of a CHF 3,000 advance and then granted an additional deadline under Art. 62(3) LTF. As payment still did not occur, inadmissibility followed under Art. 62(3) LTF and Art. 108(1)(a) LTF.

Key legal question

Whether judicial costs should be charged despite inadmissibility.

Extracted holding

No judicial costs were charged.

Extracted reasoning

The dispositive part expressly states that no court costs are imposed.
