Omnilex summary

The Federal Supreme Court did not enter on the appeal filed by X.________ in liquidation against the cantonal judgment because the submission attacked the district court proceedings and failed to meet the reasoning requirements for an appeal to the Federal Supreme Court. The request for legal aid was denied as hopeless, and court costs of CHF 500 were charged to the appellant.

Omnilex headnote

Art. 42 Abs. 1 and 2, Art. 75 Abs. 1, Art. 106 Abs. 2 and Art. 108 Abs. 1 lit. a and b BGG; requirements for admissibility and reasoning of a Federal Supreme Court appeal. An appeal must address the reasoning of the challenged cantonal decision and, with reference to that reasoning, show which rights were violated. Criticism of the first-instance proceedings is inadmissible where the cantonal judgment alone is under review. Alleged violations of constitutional rights are examined only if expressly invoked and substantiated. A manifestly insufficiently reasoned appeal is not entered on in summary procedure. Legal aid is refused if the appeal appears hopeless; in that event, costs are generally borne by the unsuccessful appellant (Art. 64 and 66 BGG).

Urteil vom 18. Januar 2013
I. zivilrechtliche Abteilung

Besetzung
Bundesrichterin Klett, Präsidentin,
Gerichtsschreiber Huguenin.

Verfahrensbeteiligte
X.________ in Liquidation,
Beschwerdeführerin,

gegen

Bank Y.________,
Beschwerdegegnerin.

Gegenstand
Darlehen,

Beschwerde gegen das Urteil des Kantonsgerichts des Kantons Wallis, I. zivilrechtliche Abteilung, vom 15. November 2012.

In Erwägung,
dass das Bezirksgericht Leuk und Westlich-Raron mit Entscheid vom 26. September 2012 auf die Aberkennungsklage der Beschwerdeführerin nicht eintrat, weil diese den von ihr verlangten Kostenvorschuss nicht bezahlt hatte;
dass die Beschwerdeführerin diesen Entscheid am 26. Oktober 2012 mit Berufung beim Kantonsgericht Wallis anfocht;
dass das Kantonsgericht mit Urteil vom 15. November 2012 aus formellen Gründen auf die Berufung nicht eintrat;
dass die Beschwerdeführerin dem Bundesgericht eine vom 14. Dezember 2012 datierte Eingabe einreichte, in der sie erklärte, das Urteil des Kantonsgerichts anzufechten;
dass von vornherein auf die Beschwerde nicht einzutreten ist, soweit die Beschwerdeführerin in ihrer Rechtsschrift das Verfahren vor dem Bezirksgericht kritisiert (Art. 75 Abs. 1 BGG);
dass in einer Beschwerde an das Bundesgericht unter Bezugnahme auf die Erwägungen des angefochtenen Entscheides dargelegt werden muss, welche Rechte der beschwerdeführenden Partei durch das kantonale Gericht verletzt worden sind (Art. 42 Abs. 1 und 2 BGG), wobei eine allfällige Verletzung der bundesrechtlichen Verfassungsrechte vom Bundesgericht nicht von Amtes wegen geprüft wird, sondern nur dann, wenn solche Rügen in der Beschwerdeschrift ausdrücklich erhoben und begründet werden (Art. 106 Abs. 2 BGG);
dass die Eingabe der Beschwerdeführerin vom 14. Dezember 2012 diesen Begründungsanforderungen offensichtlich nicht genügt, soweit sie sich zum Entscheid des Kantonsgerichts äussert;
dass aus diesen Gründen auf die Beschwerde im Verfahren nach Art.108 Abs. 1 lit. a und b BGG nicht einzutreten ist;
dass das sinngemäss gestellte Gesuch um Gewährung der unentgeltlichen Rechtspflege, über das unter den gegebenen Umständen nicht vorgängig separat entschieden werden musste (vgl. Urteil 4A_20/2011 vom 11. April 2011 E. 7.2.2), wegen Aussichtslosigkeit der Beschwerde abzuweisen ist (Art. 64 Abs. 1 BGG);
dass die Gerichtskosten der Beschwerdeführerin aufzuerlegen sind (Art. 66 Abs. 1 BGG);

erkennt die Präsidentin:

1.
Auf die Beschwerde wird nicht eingetreten.

2.

Extracted by Omnilex

Key legal question

Whether the Federal Supreme Court could examine criticisms directed at the first-instance proceedings.

Extracted holding

No. Such criticisms were not admissible in this appeal against the cantonal judgment.

Extracted reasoning

The appeal had to address the reasoning of the challenged cantonal decision; complaints directed only at the district court fell outside the scope of review under the Federal Supreme Court appeal rules.

Key legal question

Whether the appeal met the Federal Supreme Court's reasoning requirements.

Extracted holding

No. The submission did not sufficiently explain which rights were violated by the cantonal court.

Extracted reasoning

The appellant failed to substantiate specific violations of federal law or constitutional rights in the manner required by the appeal provisions.

Key legal question

Whether legal aid should be granted.

Extracted holding

No. The appeal was manifestly hopeless.

Extracted reasoning

Because the appeal was inadmissible and lacked sufficient reasoning, it was prospectless, so the conditions for legal aid were not met.

Key legal question

Who bears the court costs.

Extracted holding

The appellant bears the costs.

Extracted reasoning

As the appeal was not entered on and the appellant was unsuccessful, costs were imposed on her under the Federal Supreme Court Act.
