Omnilex summary

In an eviction dispute, the tenant challenged a cantonal non-entry decision before the Federal Supreme Court. The court held that the filing did not meet the strict federal reasoning requirements for constitutional complaints because it did not address the cantonal court’s reasons or substantiate any constitutional violation. It therefore did not enter into the complaint. The request for free legal aid was rejected as hopeless. The appellant was ordered to pay CHF 500 in court costs, and the respondent received no party compensation.

Omnilex headnote

Art. 42 Abs. 2, Art. 106 Abs. 2 i.V.m. Art. 117 BGG; Art. 108 Abs. 1 lit. b BGG; requirements for reasoning of a constitutional complaint and non-entry for manifestly insufficient substantiation. A federal remedy must, by reference to the challenged reasoning, explain which rights were violated and in what respect. Constitutional grievances are examined only if expressly raised and properly reasoned; mere disagreement with the result is insufficient. Where the complaint is hopeless, legal aid is to be refused under Art. 64 BGG. Court costs follow the outcome under Art. 66 Abs. 1 BGG; party compensation under Art. 68 Abs. 2 BGG presupposes compensable expense.

vertreten durch Advokat Michel de Roche,
Beschwerdegegnerin.

Gegenstand
Mieterausweisung,

Verfassungsbeschwerde gegen den Entscheid des Kantonsgerichts Basel-Landschaft, Abteilung Zivilrecht, vom 17. Dezember 2013.

In Erwägung,
dass die Präsidentin des Bezirksgerichts Arlesheim X.________, Z.________, (Beschwerdeführerin) unter Androhung der polizeilichen Vollstreckung im Nichtbefolgungsfall anwies, die Mietobjekte (3-Zimmerwohnung im Obergeschoss Nr. qqq, Keller sowie Bastelraum Nr. ppp und Autoeinstellplatz Nr. rrr) in Z.________ bis spätestens 11. November 2013, 12:00 Uhr mittags, zu räumen;
dass das Kantonsgericht Basel-Landschaft auf die von der Beschwerdeführerin mit Eingabe vom 1. November 2013 erhobene Beschwerde mangels hinreichender Begründung mit Entscheid vom 17. Dezember 2013 nicht eintrat;
dass die Beschwerdeführerin dem Bundesgericht mit Eingabe vom 10. Januar 2014 erklärte, den Entscheid des Kantonsgerichts Basel-Landschaft vom 17. Dezember 2013 mit Beschwerde anfechten zu wollen;
dass das Bundesgericht das Gesuch der Beschwerdeführerin um Gewährung der aufschiebenden Wirkung mit Verfügung vom 14. Januar 2014 abwies;
dass in den Rechtsmitteln an das Bundesgericht unter Bezugnahme auf die Erwägungen des kantonalen Entscheids dargelegt werden muss, welche Rechte der beschwerdeführenden Partei durch das kantonale Gericht verletzt worden sind (Art. 42 Abs. 2 BGG), wobei eine allfällige Verletzung verfassungsmässiger Rechte vom Bundesgericht nicht von Amtes wegen geprüft wird, sondern nur dann, wenn entsprechende Rügen in der Beschwerdeschrift ausdrücklich erhoben und begründet werden (Art. 106 Abs. 2 i.V.m. Art. 117 BGG);
dass sich die Beschwerdeführerin nicht mit den Erwägungen des angefochtenen Entscheids des Kantonsgerichts Basel-Landschaft vom 17. Dezember 2013 auseinandersetzt und aufzeigt, inwiefern mit dem Nichteintretensentscheid ihre verfassungsmässigen Rechte verletzt wurden;
dass die Eingabe der Beschwerdeführerin vom 10. Januar 2014 die erwähnten Begründungsanforderungen daher offensichtlich nicht erfüllt, weshalb auf die Beschwerde in Anwendung von Art. 108 Abs. 1 lit. b BGG nicht eingetreten werden kann;
dass das sinngemäss gestellte Gesuch um Gewährung der unentgeltlichen Rechtspflege bereits wegen Aussichtslosigkeit der Beschwerde abzuweisen ist (Art. 64 BGG);
dass die Gerichtskosten dem Verfahrensausgang entsprechend der Beschwerdeführerin aufzuerlegen sind (Art. 66 Abs. 1 BGG);
dass die Beschwerdegegnerin keinen Anspruch auf eine Parteientschädigung hat, da ihr aus dem bundesgerichtlichen Verfahren kein Aufwand erwachsen ist (Art. 68 Abs. 2 BGG);

erkennt die Präsidentin:

1.

Auf die Beschwerde wird nicht eingetreten.

2.

Extracted by Omnilex

Key legal question

Whether the constitutional complaint met the federal reasoning requirements

Extracted holding

No. The filing did not engage with the cantonal reasons or show any violation of constitutional rights.

Extracted reasoning

Under Art. 42(2) and Art. 106(2) in conjunction with Art. 117 BGG, constitutional grievances must be expressly raised and substantiated. The appellant failed to do so, so the complaint was manifestly insufficiently reasoned.

Key legal question

Whether leave to proceed in forma pauperis should be granted

Extracted holding

No, because the complaint had no prospects of success.

Extracted reasoning

Unsuccessful proceedings do not justify legal aid when the appeal is hopeless.

Key legal question

Allocation of court costs and party compensation

Extracted holding

Court costs were imposed on the appellant, and no party compensation was awarded to the respondent.

Extracted reasoning

Costs follow the outcome; the respondent incurred no compensable expense in the federal proceedings.
