Omnilex summary

X. filed a constitutional complaint against a cantonal appellate decision that had declared his cantonal appeal late. The Federal Supreme Court held that his submission did not meet the reasoning requirements because it attacked provisions unrelated to the challenged decision and did not show a constitutionally relevant violation. The Court therefore refused to enter into the matter under the simplified procedure. It waived court fees and denied the respondent costs, since she had not been invited to respond.

Omnilex headnote

Art. 42 al. 2 LTF; Art. 108 al. 1 LTF; admissibility of a constitutional complaint: a submission must, in a reasoned manner, engage with the decisive considerations of the challenged judgment and indicate, with reference to the applicable legal provisions, why the decision is unlawful. Mere invocations of unrelated norms or abstract constitutional provisions are insufficient. If the appeal manifestly fails to satisfy the reasoning requirements, the Court may decide under the simplified procedure and decline to enter into the matter (consid. 2).

Greffier: M. Carruzzo.

Parties
X.________,
recourant,

contre

A.________,
intimée, représentée par Me Elie Elkaim.

Objet

Extracted by Omnilex

Key legal question

Whether the constitutional complaint met the Federal Supreme Court's reasoning requirements.

Extracted holding

The complaint did not satisfy the statutory reasoning requirements and could not be examined on the merits.

Extracted reasoning

The appellant criticized provisions unrelated to the cantonal decision and invoked constitutional articles without showing a link to the challenged reasoning; this was manifestly insufficient under Art. 42(2) LTF.

Key legal question

Whether the Federal Supreme Court should enter into the constitutional complaint despite the defective reasoning.

Extracted holding

No entry into the matter.

Extracted reasoning

Because the appeal was manifestly non-compliant, the simplified procedure applied and the complaint was left unexamined.

Key legal question

Court costs and party compensation.

Extracted holding

No court fee was charged and no costs were awarded to the respondent.

Extracted reasoning

Given the circumstances, the Court waived the judicial fee; the respondent had not been invited to comment and therefore had no entitlement to costs.
