Omnilex summary

X. challenged a cantonal decision on attorney fees and requested legal aid for the appeal. The First Civil Law Court of the Federal Supreme Court held that the letter did not meet the motivation requirements for an appeal and therefore did not enter into the matter in simplified procedure. It further held that, because the non-extendable appeal deadline had already expired, appointing counsel was no longer possible. The court waived judicial fees.

Omnilex headnote

Art. 42 al. 2 LTF, art. 108 al. 1 let. b LTF; non-entry for insufficiently reasoned appeal. A filing that merely announces the intention to challenge a cantonal judgment, without presenting specific reasons and legal arguments, is manifestly inadmissible and may be disposed of by the single judge in simplified procedure. If the non-extendable appeal period has expired, appointment of counsel to prepare the appeal is excluded. Under art. 66 al. 1 LTF, judicial fees may be waived in light of the circumstances.

Objet
honoraires d'avocat,

recours constitutionnel contre l'arrêt rendu le 1er avril 2008 par la Cour de modération du Tribunal cantonal de l'Etat de Fribourg.

Le Président de la Ire Cour de droit civil,
Vu l'arrêt rendu le 1er avril 2008 par la Cour de modération du Tribunal cantonal de l'Etat de Fribourg dans la cause opposant X.________ à Y.________;
Vu la lettre du 1er mai 2008 dans laquelle X.________ manifeste la volonté de recourir contre ledit arrêt et sollicite une "aide judiciaire" à cette fin;
qu'il n'est, dès lors, pas possible d'entrer en matière, ce qui peut être constaté en procédure simplifiée (art. 108 al. 1 let. b LTF);
Considérant que, dans la mesure où le délai de recours, qui ne peut être prolongé, a déjà expiré, la désignation d'un avocat d'office susceptible de venir en aide au recourant pour la rédaction du mémoire de recours n'entre plus en ligne de compte;

Key legal question

Whether the letter could be treated as an admissible appeal under the Federal Supreme Court Act

Extracted holding

No; the submission did not satisfy the reasoning requirements of Art. 42(2) LTF, so the court could not enter into the matter.

Extracted reasoning

The writer merely indicated an intention to challenge the cantonal judgment and provided no substantiated legal arguments; non-entry could therefore be decided in simplified proceedings.

Key legal question

Whether an ex officio lawyer should be appointed after expiry of the appeal period

Extracted holding

No; once the non-extendable appeal deadline had expired, counsel could no longer be appointed to assist with drafting the appeal.

Extracted reasoning

Legal aid for preparing an appeal presupposes that a usable filing can still be made within the applicable time limit.

Key legal question

Whether court costs should be charged

Extracted holding

Court costs were waived in view of the circumstances.

Extracted reasoning

The president exercised discretion under the LTF to renounce the judicial fee.
