Omnilex summary

In an appeal to the Federal Supreme Court concerning a debt-enforcement matter, the parties informed the Court that they had concluded an extrajudicial settlement and jointly requested that the case be removed from the docket. The Court held that the settlement ended the proceedings. It fixed judicial costs at CHF 4,000, taking account of the work already performed, and charged them to the appellant because he withdrew the appeal. The parties had also agreed to waive any award of party costs, so no dépens were granted.

Omnilex headnote

Extrajudicial settlement; withdrawal of the appeal and striking the case from the docket. A settlement concluded by the parties renders the proceedings moot and justifies removal from the docket. Court costs are to be set in light of the work already carried out by the court and are ordinarily borne by the withdrawing appellant. Where the parties expressly waive party compensation, no dépens are awarded (consid. 1).
