Omnilex summary

The Federal Supreme Court did not enter into the complaint against the Zurich Cassation Court's decision on the non-lifting of a guardianship because the appellant failed to pay the required CHF 1,000 advance on costs within the final, non-extendable deadline and did not provide proof of timely payment. The appellant was ordered to pay court costs of CHF 150.

Omnilex headnote

Art. 62 Abs. 3, 48 Abs. 4 and 108 Abs. 1 lit. a BGG; non-payment of the advance on costs within the non-extendable deadline results in non-entry. If the appellant neither pays the advance in cash nor proves timely debit of a Swiss postal or bank account in accordance with the prescribed procedure, the complaint is inadmissible without further examination. In such cases, court costs are imposed on the appellant under Art. 66 Abs. 1 BGG (consid. 1).

Gegenstand
Nichtaufhebung einer Vormundschaft,

Nach Einsicht
in die Beschwerde nach Art. 72ff. BGG gegen den Zirkulationsbeschluss vom 11. Februar 2008 des Kassationsgerichts des Kantons Zürich,

in Erwägung,
Extracted by Omnilex

Key legal question

Whether the complaint should be entered into despite the appellant's failure to pay the advance on costs within the final deadline.

Extracted holding

No. Because the advance on costs was neither paid in cash nor properly credited by payment order proof within the non-extendable deadline, the Court had to refuse entry.

Extracted reasoning

After a warning under Art. 62(3) BGG, the appellant did not comply with the advance-payment order or provide the required proof of timely payment; under Art. 108(1)(a) BGG this leads to non-entry.

Key legal question

Who bears the court costs of the federal proceedings.

Extracted holding

The appellant bears the court costs.

Extracted reasoning

As the complaint was not entered into, costs were imposed on the unsuccessful appellant under Art. 66(1) BGG.
