Omnilex summary

The Federal Supreme Court noted that complaints against supervisory decisions in debt enforcement and bankruptcy are not free of charge, so the cost advance request was lawful. The complainant then withdrew its complaint by letter of 16 April 2010. The president accordingly struck the proceedings from the docket and imposed court costs of CHF 200 on the complainant. The order was communicated to the parties, the debt enforcement office, and the cantonal supervisory court.

Key legal question

Whether the complaint proceedings should be struck off after withdrawal.

Extracted holding

The proceedings were struck off as concluded by withdrawal of the complaint.

Extracted reasoning

The complainant withdrew the complaint by letter of 16 April 2010; the order was therefore to be issued by the division president and the case dismissed from the docket.

Key legal question

Whether court costs had to be imposed despite the withdrawal.

Extracted holding

Court costs of CHF 200 were imposed on the complainant.

Extracted reasoning

Complaints against decisions of debt-enforcement and bankruptcy supervisory authorities are not free of charge; therefore the request to pay an advance was proper and, upon withdrawal, costs were allocated to the complainant.
