Omnilex summary

The appellant in a debt-enforcement attachment matter sought federal review but did not pay the CHF 400 advance costs within the extended deadline after her legal-aid request was denied as hopeless. She also filed a reconsideration request, which the Federal Supreme Court found unsubstantiated. The court therefore did not enter into either the reconsideration request or the appeal and ordered the appellant to pay CHF 300 in court costs.

Omnilex headnote

Art. 62 Abs. 3 BGG, Art. 108 Abs. 1 lit. a BGG; non-payment of the advance on costs after expiry of the granted deadline leads to non-entry into the appeal. A reconsideration request against the refusal of legal aid is inadmissible where it does not allege any circumstances justifying a departure from the original decision. If the court does not enter into the appeal, the appellant bears the court costs under Art. 66 Abs. 1 BGG.

Gegenstand

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the request for reconsideration of the denial of legal aid should be entertained

Extracted holding

The reconsideration request was not entertained because it raised nothing that justified revisiting the earlier denial of legal aid.

Extracted reasoning

The submission of 15 April 2010 contained no new arguments capable of overturning the 8 April 2010 order refusing legal aid.

Key legal question

Whether the appeal could proceed despite non-payment of the advance costs

Extracted holding

The court did not enter into the appeal because the appellant failed to pay the required CHF 400 advance within the extended deadline and did not prove timely payment.

Extracted reasoning

After the warning under Art. 62 Abs. 3 BGG, the conditions for non-entry under Art. 108 Abs. 1 lit. a BGG were met.

Key legal question

Costs of the federal proceedings

Extracted holding

Court costs were imposed on the appellant.

Extracted reasoning

Because the appeal was not entered into, the appellant had to bear the costs under Art. 66 Abs. 1 BGG.
