Omnilex summary

The appellant challenged a cantonal bankruptcy decision after the creditor withdrew the bankruptcy request. The Federal Supreme Court requalified the filing as a civil appeal but found that it lacked conclusions and any comprehensible, legally sufficient reasoning against the cantonal judgment. It therefore declared the appeal inadmissible in simplified procedure. The appellant’s request to stay the proceedings pending another case in Bern was also rejected for want of reasoning. Court costs of CHF 300 were charged to the appellant.

Omnilex headnote

Art. 72 al. 2 let. a LTF, art. 42 al. 1-2 and al. 7 LTF, art. 108 al. 1 let. b LTF; requalification of a wrongly labelled filing and admissibility requirements of a federal appeal. The Federal Supreme Court requalifies a pleading ex officio according to its substance, but only if the remaining admissibility requirements are met. An appeal must contain conclusions and a reasoned critique directed against the contested grounds; absent such reasoning, and a fortiori in case of abusive conduct, it is declared inadmissible in simplified procedure. A motion to suspend proceedings must itself be reasoned; otherwise it is rejected. Costs are charged to the unsuccessful party under art. 66 al. 1 LTF.

Objet
faillite,

recours contre l'arrêt de la Cour des poursuites et
faillites du Tribunal cantonal du canton de Vaud
du 27 octobre 2010.

Considérant:
que, par arrêt du 27 octobre 2010, la cour des poursuites et faillites du Tribunal cantonal du canton de Vaud a déclaré irrecevable le recours formé par X.________ à la suite du prononcé du Président du Tribunal d'arrondissement de Lausanne prenant acte du retrait par Y.________ de sa requête de faillite;
que dite décision est motivée par le fait que le recourant avait obtenu gain de cause et n'avait, donc, pas d'intérêt au recours;
que l'intéressé interjette une plainte LP au Tribunal fédéral contre cette décision, requérant la suspension de la procédure jusqu'à droit connu dans une procédure bernoise pendante;
que, quel que soit l'intitulé de l'écriture, celle-ci sera convertie d'office en recours en matière civile (art. 72 al. 2 let. a LTF), dans la mesure où elle en remplit les autres conditions de recevabilité (ATF 134 III 379 consid. 1.2, 133 III 462 consid. 2.1);
que le recours ne contient toutefois pas de conclusions (art. 42 al. 1 LTF) ni de motivation compréhensible dirigée contre les considérants de l'autorité cantonale et, a fortiori, pas de motivation conforme aux exigences légales (art. 42 al. 2 LTF; ATF 133 IV 286 consid. 1.4 p. 287);
que, en outre, le recourant procède de manière abusive (art. 42 al. 7 LTF);
que, dans ces circonstances, le recours doit être déclaré irrecevable selon la procédure simplifiée prévue à l'art. 108 al. 1 let. b LTF;
que la demande de suspension de la procédure ne comprenant aucune motivation compréhensible, il convient de la rejeter;
que les frais de la présente procédure doivent être mis à la charge du recourant (art. 66 al. 1 LTF);

par ces motifs, la Présidente prononce:

1.
Le recours est irrecevable.

2.

Extracted by Omnilex

Key legal question

Whether the filing should be treated as a civil-law appeal despite being labeled a debt-enforcement complaint.

Extracted holding

The filing was converted ex officio into a civil-law appeal insofar as the other admissibility requirements were met.

Extracted reasoning

The Court held that the designation of the submission is not decisive; a pleading may be requalified according to its content and legal nature.

Key legal question

Whether the appeal was admissible despite lacking conclusions and comprehensible reasoning.

Extracted holding

The appeal was inadmissible because it contained neither proper conclusions nor an intelligible, legally sufficient challenge to the cantonal reasoning.

Extracted reasoning

Article 42 LTF requires conclusions and a reasoned submission directed against the contested grounds; these requirements were not met, and the appellant acted abusively.

Key legal question

Whether the proceedings should be suspended pending another case in Bern.

Extracted holding

The request for suspension was rejected because it was not supported by any comprehensible reasoning.

Extracted reasoning

A suspension request must be reasoned; absent any understandable justification, it cannot be granted.

Key legal question

Who bears the costs of the federal proceedings.

Extracted holding

Court costs were imposed on the appellant.

Extracted reasoning

As the appeal was inadmissible, the costs followed the outcome and were charged to the losing party.
