Omnilex summary

The Federal Supreme Court did not enter into the constitutional complaint against the St. Gallen cantonal decision on legal opening because the appellant failed to pay the CHF 100 advance within the extended deadline and did not prove timely payment. The appellant's later filing did not justify revisiting the earlier refusal of legal aid. Court costs of CHF 100 were imposed on him.

Omnilex headnote

Art. 62 Abs. 3 BGG, Art. 108 Abs. 1 lit. a BGG; non-payment of the advance on time leads to non-entry: if the appellant neither pays the advance within the prescribed period and grace period nor proves timely debiting in the case of a payment order, the complaint is inadmissible and must be left without consideration. Later submissions that do not raise new facts or arguments do not justify reconsideration of a prior refusal of legal aid. Costs are borne by the appellant under Art. 66 Abs. 1 BGG.

Urteil vom 17. April 2008
II. zivilrechtliche Abteilung

Besetzung
Bundesrichter Raselli, Präsident,
Gerichtsschreiber Zbinden.

Parteien
X.________,
Beschwerdeführer,

gegen

Stadt Zürich,
Beschwerdegegner,
vertreten durch Stadtrichteramt Zürich.

Gegenstand
Rechtsöffnung,

Verfassungsbeschwerde gegen den Entscheid des Kantonsgerichts St. Gallen, Präsident der III. Zivilkammer, vom 11. Dezember 2007.

Zivilkammer, vom 11. Dezember 2007,

in Erwägung,

3.
Dieses Urteil wird den Parteien und dem Kantonsgericht St. Gallen, Präsident der III. Zivilkammer, schriftlich mitgeteilt.

Key legal question

Whether the constitutional complaint was admissible despite non-payment of the advance on time.

Extracted holding

No. The complaint could not be admitted because the advance was neither paid nor properly evidenced within the deadline and grace period.

Extracted reasoning

After the warning under Art. 62(3) BGG, the appellant still did not pay the CHF 100 advance at the Federal Supreme Court cashier, did not hand it over at a post office for the court's benefit, and did not provide proof of a timely debit in case of a payment order.

Key legal question

Whether the appellant's later submissions justified reopening the question of legal aid denial.

Extracted holding

No. The later submissions of 18 March 2008 contained nothing that would justify reconsideration of the refusal of legal aid.

Extracted reasoning

The court found no new argument or circumstance capable of altering the earlier decision refusing free legal aid.
