Omnilex summary

The Federal Supreme Court held that the constitutional complaint against the Bern Higher Court’s decision on definitive debt enforcement release was filed far beyond the 30-day deadline. Since the decision had been served on 2011-11-16 and the complaint was only mailed on 2012-09-26, the filing was manifestly late. The Court therefore declined to enter into the complaint under the simplified procedure and ordered the appellant to pay court costs of CHF 100.

Omnilex headnote

Art. 100 Abs. 1, Art. 48 Abs. 1 BGG; timeliness of the constitutional complaint. The complaint must be filed within 30 days of notification of the cantonal decision, or handed over to the postal service within that period. A filing submitted after expiry of the deadline is manifestly inadmissible and gives rise to non-entry under Art. 117 in conjunction with Art. 108 Abs. 1 lit. a BGG. In such cases the simplified procedure applies and costs are borne by the unsuccessful party under Art. 66 Abs. 1 BGG (consid. 1).

Urteil vom 27. September 2012
II. zivilrechtliche Abteilung

Besetzung
Bundesrichterin Escher, präsidierendes Mitglied,
Gerichtsschreiber Füllemann.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Kanton Bern, Staatsanwaltschaft Y.________,
vertreten durch die Steuerverwaltung des Kantons Bern,
Beschwerdegegner.

Gegenstand
Definitive Rechtsöffnung,

Verfassungsbeschwerde gegen den Entscheid vom 9. November 2011 des Obergerichts des Kantons Bern (Zivilabteilung, 1. Zivilkammer).

Nach Einsicht
in die Verfassungsbeschwerde gegen den Entscheid vom 9. November 2011 des Obergerichts des Kantons Bern,

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the constitutional complaint was filed within the statutory time limit

Extracted holding

No; the complaint was submitted long after the 30-day deadline after notification of the cantonal decision.

Extracted reasoning

The cantonal judgment was served on 2011-11-16, while the complaint was handed to the post only on 2012-09-26, making it manifestly late under Arts. 100(1) and 48(1) BGG.

Key legal question

Whether the Federal Supreme Court could enter into the complaint under the simplified procedure

Extracted holding

No; the complaint was manifestly inadmissible, so non-entry was proper under the simplified procedure.

Extracted reasoning

Because the complaint was clearly out of time, non-entry followed in proceedings under Art. 117 in conjunction with Art. 108(1)(a) BGG.

Key legal question

Allocation of court costs

Extracted holding

Court costs were imposed on the losing appellant.

Extracted reasoning

Under Art. 66(1) BGG, the unsuccessful party bears the costs.
