Omnilex summary

The Federal Supreme Court held that the subsidiary constitutional complaint was inadmissible because the cantonal non-entry decision concerned A________, not the appellant estate, so no legally protected interest existed. The complaint also failed to meet the strict constitutional pleading requirements and was considered abusive. The Court therefore did not enter into the complaint, denied legal aid as hopeless, and charged CHF 200 in court costs to the appellant.

Omnilex headnote

Art. 115 lit. b BGG; subsidiäre Verfassungsbeschwerde requires a legally protected interest in the annulment or amendment of the challenged cantonal decision. A party not addressed by the impugned decision lacks standing, even if indirectly concerned. The complaint is likewise inadmissible where the constitutional grievances are not set out with clear, specific reference to the decisive reasoning of the cantonal authority (Art. 116, 117 i.V.m. Art. 106 Abs. 2 BGG). Abusive filings may be disposed of in simplified procedure under Art. 117 i.V.m. Art. 108 Abs. 1 lit. a-c BGG. Legal aid is refused where the request is manifestly hopeless (Art. 64 Abs. 1 BGG), and costs are imposed on the unsuccessful party (Art. 66 Abs. 1 BGG).

Urteil vom 25. März 2013
II. zivilrechtliche Abteilung

Besetzung
Bundesrichterin Escher, präsidierendes Mitglied,
Gerichtsschreiber Füllemann.

Verfahrensbeteiligte
Erbschaft des X.________ ("Erbengemeinschaft X.________"),
Beschwerdeführerin,

gegen

Einwohnergemeinde Y.________,
Beschwerdegegnerin.

Gegenstand

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the constitutional complaint was admissible and whether the complainant had standing under Art. 115 lit. b BGG.

Extracted holding

The complaint was inadmissible because the challenged cantonal decision was directed against A________, not against the appellant, so it lacked a legally protected interest.

Extracted reasoning

Only a person affected by the challenged decision may file a subsidiarity constitutional complaint; the appellant was not bound by the cantonal decision and therefore could not seek its annulment.

Key legal question

Whether the complaint met the constitutional pleading requirements.

Extracted holding

It did not, because no specific constitutional violation was shown with sufficient clarity and detail.

Extracted reasoning

The filing failed to engage with the decisive reasoning of the cantonal court and did not properly identify the constitutional rights allegedly violated.

Key legal question

Whether the filing was abusive and whether the complaint should be dismissed in simplified procedure.

Extracted holding

The filing was abusive and thus subject to non-entry in simplified procedure.

Extracted reasoning

The court noted abusive litigation conduct and applied Art. 117 in conjunction with Art. 108 Abs. 1 lit. a-c BGG.

Key legal question

Whether legal aid should be granted.

Extracted holding

Legal aid was denied because the complaint had no prospects of success.

Extracted reasoning

An obviously inadmissible complaint is hopeless within the meaning of Art. 64 Abs. 1 BGG.

Key legal question

Who bears the court costs.

Extracted holding

The appellant was ordered to pay court costs.

Extracted reasoning

Costs follow the outcome against the unsuccessful appellant.
