Omnilex summary

The Federal Supreme Court held that the complainant lacked standing to challenge the cantonal prosecutor's refusal to open a criminal investigation. She was neither a private prosecutor nor an injured party/victim under Art. 81 BGG. The appeal was therefore not entered into under Art. 108 BGG. Court costs of CHF 800 were imposed on the appellant.

Urteil vom 13. Januar 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführerin,

gegen

Staatsanwaltschaft des Kantons St. Gallen, Schützengasse 1, 9001 St. Gallen,
Beschwerdegegnerin.

Gegenstand

Lausanne, 13. Januar 2009

Key legal question

Whether the appellant had standing to file the criminal appeal before the Federal Supreme Court.

Extracted holding

She lacked standing because she was neither a private prosecutor nor an injured party within the meaning of Art. 81 BGG.

Extracted reasoning

The prosecution had participated in the cantonal proceedings, excluding private-prosecutor status; no direct impairment of physical or psychological integrity was shown, so victim status was also absent.

Key legal question

Whether the federal appeal had to be entered into under Art. 108 BGG.

Extracted holding

No. The appeal was not admissible for lack of standing.

Extracted reasoning

Without appeal legitimacy, the summary judge could not enter into the merits.

Key legal question

Court costs.

Extracted holding

The appellant had to bear the court costs.

Extracted reasoning

Costs were imposed on the losing party under the Federal Supreme Court Act.
