Omnilex summary

The Federal Supreme Court did not enter into the criminal complaint because the appellant failed to address the decisive cantonal ground for non-entry, namely the untimely filing of the appeal. The submission therefore did not satisfy the reasoning requirements of Art. 42(2) and Art. 106(2) BGG and could be dealt with under Art. 108 BGG. Court costs of CHF 800 were imposed on the appellant.

Urteil vom 26. Februar 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8001 Zürich, Beschwerdegegnerin.

Gegenstand
Sachbeschädigung usw.,

Beschwerde gegen den Zirkulationsbeschluss
des Obergerichts des Kantons Zürich,
I. Strafkammer, vom 10. Dezember 2008.

Der Präsident zieht in Erwägung:

1.

Lausanne, 26. Februar 2009
Im Namen der Strafrechtlichen Abteilung

Key legal question

Whether the federal complaint met the reasoning requirements despite not addressing the cantonal timeliness issue.

Extracted holding

The filing did not challenge the decisive cantonal reasoning on late filing and therefore did not satisfy the statutory reasoning requirements.

Extracted reasoning

Because the complaint failed to engage with the sole ground for the cantonal non-entry decision, it was insufficient under Art. 42(2) and Art. 106(2) BGG and could be rejected in summary procedure under Art. 108 BGG.

Key legal question

Allocation of court costs

Extracted holding

Court costs were imposed on the appellant.

Extracted reasoning

As the complaint was inadmissible, the appellant had to bear the costs under Art. 66(1) BGG.
