Omnilex summary

The Federal Supreme Court dismissed the criminal complaint against the Aargau cantonal court's refusal to enter into an appeal. The appellant had timely announced an appeal against the Lenzburg district court judgment but never filed the required reasoned statement of appeal. The Court held that the legal instruction clearly explained the two-step appeal procedure and deadlines, so the claim of misleading guidance failed. Court costs of CHF 1,000 were charged to the appellant.

Omnilex headnote

Art. 109 BGG; appeal statement after appeal announcement in criminal proceedings; legal instruction. Where the legal instruction clearly distinguishes between the timely announcement of an appeal and the subsequent obligation to file a written and reasoned statement of appeal within the statutory time limit, a party cannot rely on alleged ambiguity to excuse omission of the statement. A complaint directed against a non-entry decision is dismissed if the appellant merely announced the appeal but failed to perfect it in accordance with the applicable procedural requirements (consid. 1).

Urteil vom 6. März 2014

Strafrechtliche Abteilung

Besetzung
Bundesrichter Mathys, Präsident,
Bundesrichterin Jacquemoud-Rossari,
Bundesrichter Denys,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Aargau,
Frey-Herosé-Strasse 12, Wielandhaus, 5001 Aarau,
Beschwerdegegnerin.

Gegenstand
Grobe Verletzung der Verkehrsregeln, Berufungserklärung,

Beschwerde gegen den Beschluss des Obergerichts des Kantons Aargau, Strafgericht, 3. Kammer, vom 14. Januar 2014.

Das Bundesgericht zieht in Erwägung:

1.

3.

Dieses Urteil wird den Parteien und dem Obergericht des Kantons Aargau, Strafgericht, 3. Kammer, schriftlich mitgeteilt.

Key legal question

Whether the cantonal court rightly refused to enter into the appeal because no statement of appeal was filed after the announcement.

Extracted holding

The refusal to enter into the appeal was lawful because the appellant did not comply with the statutory duty to file a written, reasoned statement of appeal after receiving the reasoned judgment.

Extracted reasoning

The appeal instruction was clear: an announcement without reasons was sufficient only to preserve the appeal, but a later written and reasoned statement had to be filed within 20 days. The appellant's contrary reading was not persuasive.

Key legal question

Whether the legal instruction of the first-instance court was misleading for a German jurist.

Extracted holding

No. The instruction clearly distinguished between announcing the appeal and subsequently filing the reasoned statement of appeal.

Extracted reasoning

The instruction expressly stated the two-step procedure and the relevant deadlines; any alleged ambiguity was unfounded, especially for a legally trained person.
