Omnilex summary

The Federal Supreme Court did not enter into the criminal complaint. It refused to review the district court judgment because that decision was not directly final under Art. 80(1) BGG. It also held that the complaint failed to meet the reasoning requirements: the appellant did not deal with the missing appeal declaration required by Art. 399(3) StPO and did not substantiate any improper composition of the cantonal court. Court costs of CHF 800 were imposed on the appellant.

Omnilex headnote

Art. 80 Abs. 1 BGG; Art. 399 Abs. 3 StPO; Art. 108 BGG; inadmissibility of a federal complaint for lack of a final cantonal decision and insufficient reasoning. A first-instance judgment cannot be attacked directly before the Federal Supreme Court when it is not the last cantonal instance. A complaint that fails to engage with the decisive procedural ground of the cantonal non-entry decision and does not substantiate the alleged procedural defect does not satisfy the minimum reasoning requirements and is not entered upon under Art. 108 BGG. Costs follow the outcome under Art. 66 Abs. 1 BGG.

Urteil vom 22. März 2012
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Luzern, Postfach 3439, 6002 Luzern,
Beschwerdegegnerin.

Gegenstand
Widerhandlungen gegen das Strassenverkehrsgesetz,

Beschwerde gegen den Beschluss des Obergerichts des Kantons Luzern, 4. Abteilung, vom 13. Januar 2012.

Der Einzelrichter zieht in Erwägung:

1.

Abteilung, schriftlich mitgeteilt.
