Non-entry due to inadequate appeal request and statement

Omnilex summary

The Federal Supreme Court did not enter into the criminal complaint because the appellant failed to engage with the cantonal court's reasoning that his filing lacked both a sufficient request for a written judgment and a notice of appeal. His assertion that he wanted to object was irrelevant to the legal issue. The court therefore issued a non-entry decision and charged him with court costs of CHF 800.

Omnilex headnote

Art. 108 BGG; inadmissibility of a complaint that does not substantively engage with the challenged decision. A filing which merely asserts, without legal reasoning, that the party wanted to object or appeal and does not address the decisive cantonal grounds is manifestly unsuitable for consideration. In such circumstances, the Federal Supreme Court may decide in summary procedure by non-entry. Court costs are borne by the unsuccessful party under Art. 66 Abs. 1 BGG.

Urteil vom 18. Mai 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Thurgau, Staubeggstrasse 8, 8510 Frauenfeld.

Gegenstand

April 2007.

Das Präsidium zieht in Erwägung:
1.

Key legal question

Whether the criminal complaint/appeal was admissible before the Federal Supreme Court despite the appellant's submissions

Extracted holding

The submissions did not address the legal requirements for a proper request under cantonal law and were therefore inadmissible; the federal complaint was not entered into.

Extracted reasoning

The appellant's statement that he 'obviously' wanted to object and that nobody would accept such a judgment did not engage with the challenged reasoning. The remaining arguments were plainly irrelevant. The complaint was therefore inadmissible under Art. 108 BGG.

Key legal question

Allocation of court costs

Extracted holding

Court costs were imposed on the appellant.

Extracted reasoning

As the complaint was not entered into, the appellant had to bear the costs under Art. 66(1) BGG.
