Omnilex summary

The applicant challenged the discontinuance of a criminal investigation concerning alleged police mistreatment. The Federal Supreme Court held that the complaint did not satisfy the statutory reasoning requirements because it failed to address the cantonal court's decisive reasons. It therefore did not enter into the merits of the complaint. Court costs of CHF 800 were charged to the applicant.

Omnilex headnote

Art. 106 Abs. 2 BGG; requirement of sufficiently reasoned complaint before the Federal Supreme Court; Art. 108 BGG, non-entry where the submission does not engage with the challenged reasoning. A constitutional or Convention-based argument must be developed in a manner enabling review of the decisive cantonal considerations; mere assertion of a violation is insufficient. Where the admissibility requirements are not met, the court may decide by simplified procedure and charge costs to the unsuccessful party pursuant to Art. 66 Abs. 1 BGG.

Urteil vom 7. Juni 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführerin,

gegen

Staatsanwaltschaft des Kantons Luzern, Zentralstrasse 28, 6002 Luzern.

Gegenstand
Einstellungsentscheid,

Februar 2007.

Das Präsidium zieht in Erwägung:
1.
