Omnilex summary

The Federal Supreme Court dismissed the criminal complaint as inadmissible because the complainant did not engage with the cantonal court's reasoning and failed to meet the federal substantiation requirements. The same deficiency affected the complaint against the costs order from the cantonal appeal proceedings. Court costs of CHF 800 were imposed on the complainant.

Omnilex headnote

Art. 42 Abs. 2 and Art. 106 Abs. 2 BGG; admissibility of a complaint depends on specific engagement with the reasoning of the challenged decision. A federal complaint that merely repeats or develops general criticism without addressing the decisive cantonal grounds does not satisfy the duty to reason and is inadmissible in summary procedure under Art. 108 BGG. The same applies to ancillary objections, including challenges to costs, where they are not independently substantiated. Where the complaint is inadmissible, court costs may be charged to the complainant under Art. 66 Abs. 1 BGG.

Urteil vom 16. Mai 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Generalprokurator des Kantons Bern, Hochschulstrasse 17, 3012 Bern,
Beschwerdegegner.

Gegenstand

Extracted by Omnilex

Key legal question

Whether the federal complaint met the reasoning requirements.

Extracted holding

The complaint did not address the cantonal court's reasoning on the insufficiency of the cantonally filed appeal and therefore did not satisfy the federal reasoning requirements.

Extracted reasoning

The applicant failed to engage with the key point of the challenged decision and thus did not comply with Art. 42(2) and Art. 106(2) BGG; the Court therefore could not examine the merits under Art. 108 BGG.

Key legal question

Whether the challenge to the allocation of cantonal appeal costs could be heard.

Extracted holding

That objection was likewise insufficiently reasoned and could not be reviewed.

Extracted reasoning

Because the complaint did not satisfy the federal substantiation requirements, the costs challenge was inadmissible as well.
