Omnilex summary

The Federal Supreme Court held that the criminal appeal could not be considered because the appellant failed to sign the submission properly and did not cure the defect within the deadline granted under the Federal Supreme Court Act. The court therefore issued a non-entry decision and ordered the appellant to pay court costs of CHF 500. The decision was notified to the appellant, the Stadtrichteramt Zürich, and the Zurich Cantonal Court, III Criminal Chamber.

Omnilex headnote

Art. 42 Abs. 1 und 5 BGG; Art. 108 BGG; signature requirement for pleadings before the Federal Supreme Court. A pleading lacking the required handwritten signature is defective. If the court sets a deadline to cure the defect and the party does not comply, the submission remains disregarded and the court does not enter into the matter under Art. 108 BGG. The defect is not cured by mere silence or inaction. Court costs are borne by the unsuccessful party under Art. 66 Abs. 1 BGG.

Urteil vom 21. September 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiberin Arquint Hill.

Parteien
X.________,
Beschwerdeführer,

gegen

Stadtrichteramt Zürich, Gotthardstrasse 62, Postfach, 8022 Zürich.

Gegenstand
Gerichtliche Beurteilung,

Beschwerde in Strafsachen gegen den Beschluss des Obergerichts des Kantons Zürich, III. Strafkammer, vom 2. Mai 2007.

Der Präsident zieht in Erwägung:
1.

3.
Dieses Urteil wird dem Beschwerdeführer, dem Stadtrichteramt Zürich und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.
Lausanne, 21. September 2007

Key legal question

Whether the criminal appeal was admissible despite lacking a proper signature and despite non-compliance with the cure deadline.

Extracted holding

The appeal was not entered into because the signature defect was not cured within the set deadline.

Extracted reasoning

Under Art. 42(1) and 42(5) BGG, pleadings must be signed and defects must be remedied by the deadline. The appellant did not respond, so the court applied Art. 108 BGG and declined to consider the appeal.

Key legal question

Who bears the court costs for the non-entry decision?

Extracted holding

The appellant must bear the court costs.

Extracted reasoning

Costs follow Art. 66(1) BGG when the appeal is not entered into.
